THE THING is designed to emulate the functionality of a Bulletin Board System. It allows for multiple user access levels, paging, threaded messaging and more. These advanced features facilitate user interaction and improve the workflow between artists, moderators, writers and editors.

To fully experience THE THING, you need a Java enabled Browser, at least Netscape Communicator 4.0, or Internet Explorer 3.01.

A Brief History Of The Thing:

In 1991, THE THING began as a Bulletin Board System focusing on contemporay art and cultural theory.

In 1995, THE THING was renovated and moved its wares onto the web.

In 1998, Max Kossatz designed "The Thing Communicator" which gave THE THING its present form and shape.

1. General Information.

THE THING is a Bulletin Board Service (BBS) operated by THE THING Inc. THE THING is dedicated to fostering communication and community in the field of new technologies and fine art.

Your right to use THE THING BBS is personal to you and is not transferable. You are responsible for all postings contributed from your e-mail address by any person.

THE THING Inc. may modify these terms and conditions from time to time, and such modifications will be effective upon notice posted in The Thing Newsletter.

2. Member Submissions

By posting material to THE THING BBS you agree to grant THE THING Inc. the non-exclusive, worldwide, perpetual, royalty-free right to reproduce, modify, edit, publish, sub-license, make derivative works from and distribute such material in any form or media. THE THING Inc. reserves the right, in its sole discretion, to edit any subscriber posting, and to chose to include or not include such posting in THE THING BBS.

You must own all rights to any material that you submit to THE THING BBS or, if you have the right to post works copyrighted by another, you must include with your posting a statement describing where you obtained the work. In no event may you post to THE THING BBS any material protected by copyright without the permission of the copyright owner.

Although we encourage thoughtful criticism, you may not post any material that defames any person, invades their privacy, infringes their right of publicity, infringes their trademark or other rights, or which is otherwise unlawful.

3. No Commercial Use

Postings to THE THING BBS may not include any advertising or commercial solicitation. You may not distribute any material posted to THE THING BBS for any commercial purposes.

The contents of THE THING BBS are copyrighted under United States copyright laws. 6. Disclaimer of Warranty; Limitation of Liability

NEITHER THE THING INC. NOR ITS EMPLOYEES, AGENTS, REPRESENTATIVES, INFORMATION PROVIDERS OR LICENSORS ("AFFILIATES") REPRESENT OR WARRANT THE ACCURACY, RELIABILITY, TIMELINESS OR COMPLETENESS OF ANY OPINION, STATEMENT OR OTHER MATERIAL POSTED ON THE THING BBS OR THAT THE SAME IS NON-DEFAMATORY, NON-INFRINGING OF COPYRIGHT OR OTHER RIGHTS, OR OTHERWISE LAWFUL. 7. Indemnification

You agree to defend, indemnify and hold harmless THE THING Inc. and its Affiliates from and against all claims and expenses (including attorneys' fees) arising out of any posting to THE THING BBS by you or anyone using your e-mail account or any breach by you of the terms of this agreement.

8. Right to Terminate Membership

THE THING Inc. reserves the right to terminate your membership to THE THING BBS at any time in the event that it considers, in its sole discretion, any conduct by you to be in violation of the terms of this agreement or otherwise in violation of the spirit of THE THING.

9. Miscellaneous

This agreement constitutes the entire agreement of the parties with respect to such subject matter of this agreement. No waiver by either party of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default. This agreement shall be construed in accordance with the laws of the State of New York, without regard to its conflict of laws rules.
